California DUI Laws & Penalties
Last reviewed:
California charges DUI under Vehicle Code § 23152(a) (impairment) and § 23152(b) (0.08+ per se) — usually both.
Overview
- Legal BAC limit: 0.08% (commercial 0.04%, under-21 0.01%, enhanced at 0.15%).
- Lookback period: 10 years. Priors (including wet reckless) count for 10 years, measured offense-date to offense-date.
- Primary statute: Cal. Veh. Code § 23152; penalties §§ 23536–23550
0.15+ is a statutory sentencing aggravator (VC § 23578); 0.20+ triggers the 9-month DUI program on a first offense. Also 0.04 for ride-hail/taxi drivers with a passenger.
Penalties by offense
| Offense | Classification | Jail | Fine | License suspension | Interlock |
|---|---|---|---|---|---|
| First offense | misdemeanor | 96 hours – 6 months; mandatory min none in practice — informal probation typically substitutes for jail | $390–$1,000 (base fine; with penalty assessments the real total is commonly ~$2,000+) | 6 months (court) / 4 months (DMV APS) – 10 months (0.20+); hardship: IID for 6 months = full driving privileges (SB 1046), or restricted work/program license for 12 months without IID | Not required |
| Second offense | misdemeanor | 96 hours – 1 year; mandatory min 96 hours | $390–$1,000 (base fine plus penalty assessments) | 2 years; hardship: IID for 12 months restores full driving privileges immediately (SB 1046) | Required |
| Third offense | misdemeanor | 120 days – 1 year; mandatory min 120 days | $390–$1,000 (base fine plus penalty assessments) | 3 years (revocation) – 3 years; hardship: IID for 24 months restores driving privileges (SB 1046) | Required |
| Fourth+ offense | felony ('wobbler' charged as felony) | 16 months – 3 years (state prison terms: 16 months / 2 / 3 years); mandatory min 180 days if reduced | $390–$1,000 (base fine plus penalty assessments; felony fines can run higher via § 23550) | 4 years (revocation) – 4 years; hardship: IID for 36 months | Required |
First offense

Ignition interlock
SB 1046 (statewide since Jan 1 2019, VC § 23575.3): repeat offenders and injury-DUI first offenders must install an IID (6 mo first-with-injury, 12 mo second, 24 mo third, 36 mo fourth+) in exchange for immediate full driving privileges; non-injury first offenders may choose 6-month IID or a 12-month restricted license.
