North Carolina DWI Laws & Penalties

Last reviewed:

NC sentences DWI by LEVELS (A1, 1–5) set by aggravating/mitigating factors at a sentencing hearing — NOT by a simple first/second/third ladder. Pages must explain the level system; the offense-count table below maps the typical outcomes.

Overview

0.15+ is an aggravating factor at sentencing AND triggers ignition interlock on the post-suspension license. Under-21 is zero tolerance (any BAC = separate offense).

First offense

  • Classification: misdemeanor (typically Levels 3–5 absent grossly aggravating factors)
  • Jail: 24 hours (Level 5 — often served as community service/special probation) – 6 months (Level 3); mandatory min Level 5: 24 hrs; Level 4: 48 hrs; Level 3: 72 hrs (jail or equivalent conditions)

  • License suspension: 1 year; hardship: limited driving privilege generally available (after 10 days if 0.15+ w/ interlock... conditions vary)
  • Alternative disposition: No diversion — NC prohibits DWI plea bargaining down in most circumstances; sentencing hearing factors are the whole game.
  • Interlock: Required for restoration if BAC was 0.15+.
  • Substance abuse assessment + treatment/education mandatory at every level.

Second offense

  • Classification: misdemeanor at elevated level (prior within 7 years → Level 2 or 1)

  • Jail: Aggravated Level 1: 12 months mandatory minimum – 36 months; habitual DWI felony: minimum 12 months active, unsuspendable; mandatory min 12 months (A1 / habitual)
  • Fine: $0–$10,000 (Aggravated Level 1 ≤$10,000)
  • License suspension: permanent revocation (third offense w/ priors within 5 years) – permanent; hardship: restoration petition possible after years — narrow; verify at page QC
  • Habitual DWI (§ 20-138.5): Class F felony, vehicle forfeiture.

Refusing a chemical test (implied consent)

1-year revocation for refusal (civil, via DMV), limited driving privilege possible only after 6 months. Refusal is admissible at trial.

Statute: N.C.G.S. § 20-16.2

Ignition interlock

Interlock required for license restoration when BAC was 0.15+, after repeat offenses, and for certain limited privileges; violation restarts the clock.

Statute: N.C.G.S. § 20-17.8

Frequently asked questions

What is the penalty for a first DWI in North Carolina?

A first DWI in North Carolina is a misdemeanor (typically Levels 3–5 absent grossly aggravating factors). Jail: 24 hours (Level 5 — often served as community service/special probation) – 6 months (Level 3); mandatory min Level 5: 24 hrs; Level 4: 48 hrs; Level 3: 72 hrs (jail or equivalent conditions). Fine: $200–$1,000 (Level 5 ≤$200; Level 4 ≤$500; Level 3 ≤$1,000). License suspension: 1 year; hardship: limited driving privilege generally available (after 10 days if 0.15+ w/ interlock... conditions vary).

What is the legal BAC limit in North Carolina?

0.08% for most drivers, 0.04% for commercial drivers, and 0% for drivers under 21.

How long does North Carolina look back at prior DWI offenses?

7 years. A prior conviction within 7 years is a GROSSLY aggravating factor (each prior counts separately). Habitual DWI = 3 priors within 10 years → felony. One grossly aggravating factor (other than a minor in the car) → Level 2; two → Level 1; three+ → Aggravated Level 1; a minor under 18 in the vehicle alone forces Level 1.
