Kansas DUI: First Offense

A first DUI in Kansas is generally classified as a Class B nonperson misdemeanor.

• Jail: 48 hours (or 100 hrs community service) – 6 months; mandatory min 48 hours OR 100 hrs community service
• Fine: $750–$1,000 (plus costs and fees)
• License suspension: 30-day suspension + 180-day restricted (IID) – 1 year; hardship: IID restricted license
• Ignition interlock: Required — IID required after suspension; longer if 0.15+.
• Alternative disposition: DUI diversion available for eligible first offenders (never previously diverted for DUI): charges dismissed on completion but the diversion COUNTS as a prior for future enhancement.

Lookback period: lifetime (post-2001 convictions counted). Distinctive rule: only convictions/diversions on or after July 1, 2001 count — but among those, there is NO time washout. 3rd is a felony if a prior was within 10 years; 4th+ is always a felony regardless of timing.
