A second DUI in Florida is generally classified as a misdemeanor.
Jail: 10 days mandatory if within 5 years of prior – 9 months (12 months if BAC 0.15+ or minor); mandatory min 10 days (within 5 years)
Fine: $1,000–$2,000 ($2,000–$4,000 if BAC 0.15+ or minor in vehicle)
License suspension: 5 years if within 5 years of prior (hardship after 1 year) – 5 years; hardship: after 1 year of the 5-year revocation
Ignition interlock: Required — IID minimum 1 year (2 years if BAC 0.15+).
30-day impoundment if within 5 years.
Lookback period: 5 (second-offense enhancements) / 10 (third-offense felony). Second within 5 years triggers mandatory jail, 5-year revocation, and impound; third within 10 years is a third-degree felony. Fourth offense is a felony regardless of spacing.
