License suspension periods in Georgia increase with each DUI within the lookback period:
First offense: up to 1 year; reinstatement possible after 120 days with Risk Reduction Program – 1 year; hardship: limited driving permit available for most first offenders
Second offense: 18 months (120-day hard suspension, then IID-restricted limited permit) – 18 months; hardship: IID limited permit after 120 days
Third offense: 5-year revocation (habitual violator) – 5 years; hardship: probationary license possible after 2 years
Fourth+ offense: 5-year revocation – 5 years; hardship: as third offense
Refusing the chemical test
1-year administrative license suspension ('ALS') for refusal, with NO limited permit — often worse than failing the test. 30-day window (10 business days under older rule; now 30 days) to request an ALS hearing or install IID election. Refusal of a breath test cannot be used as evidence per GA Supreme Court (Elliott v. State, 2019) — blood/urine refusal analysis differs.
